Friend appealed an unemployment benefits claim denial?

Thеу gave hіm a phone interview wіth thе Appeals Tribunal. It wаѕ supposed tο bе a conference call between thе tribunal аnd hіѕ former employer аnd hіm. Thе former employer never called іn tο discuss οr dispute іt. Hοw well dο уου thіnk thіѕ wіll work іn mу friends favor. Thе board still аѕkеd mу friend a few general qυеѕtіοnѕ. (thе employer hаd previously claimed thаt mу friend quit аnd wаѕ nοt fired without cause)

Not showing up is never good for your team.

Since the employer did not dispute any of your friend’s statements, the judge will have a hard time ruling against your friend.

It could go either way but I don’t think the “employer” is legally bound to attend the interview.

Depends on why he was denied and to some degee on the judge. If he’s appealing, he must make his case. By default, the original judgment stands. The party bringing the appeal usually has the burden of proof.

Note, this is an academic answer to an academic question on the theory that your friend no longer needs legal advice since the hearing is over. If your friend needs legal advice, contact a lawyer or a legal services entity like http://www. uac-ny. org (where I worked during law school), not Yahoo Answers.

i think your will friend because the employer didnt even care enough to call in to the hearing

Um, they Forfeited. No-Call/No-Show for the appointed interview guarantees a No-Win. Your friend should be hearing from Unemployment Insurance soon. Usually a week or two. Especially since they didn’t show up.
